Estate Document Preparation

We prepare Ohio-format estate documents to your written instructions and supervise execution with the witnesses and notarization Ohio law requires, so the documents actually work when your family needs them.

Wills and directives

What is included

  • Last will and testament with an Ohio self-proving affidavit under R.C. 2107.03
  • Statutory financial power of attorney, durable, with the powers you select expressly granted
  • Healthcare power of attorney naming your agent and alternates
  • Living will declaration covering end-of-life instructions
  • HIPAA authorization so your agent can actually obtain medical records
  • Transfer-on-death designation affidavit for Ohio real property
  • Payable-on-death and beneficiary designation review for accounts
  • Personal property memorandum and a document location letter for your family
  • Supervised signing with two disinterested witnesses and a commissioned notary

We do not prepare trusts, and we do not advise on estate tax strategy or Medicaid planning. Those are attorney matters, and we will say so on the first call.

Questions about estate document preparation

Is a will valid in Ohio without a lawyer?
Yes. Ohio Revised Code 2107.03 requires a will to be in writing, signed by the testator and attested by two competent witnesses. Nothing in Ohio law requires an attorney to draft it. What matters is that the execution formalities are followed exactly, which is what we supervise.
Why add a self-proving affidavit?
It lets the probate court accept the will without tracking down the witnesses years later. It costs nothing extra in our packages and it saves your executor real time.
Can you help me avoid probate on my house?
For Ohio real property, a transfer-on-death designation affidavit recorded with the county recorder passes the property directly to your named beneficiary outside probate. We prepare and record it for $175.
Do you prepare living trusts?
No. Trusts involve legal judgment about your circumstances, so we refer that work to independent Ohio-licensed estate attorneys. We are happy to prepare the supporting deeds and beneficiary paperwork alongside them.
How often should documents be updated?
Review every three to five years, and immediately after a marriage, divorce, birth, death, property purchase or move to another state.
